be sentenced to a non-jail time misdemeanor with 2 years probation and that will come off his record in 5 years or go to a jury trial and hope they didn't use their power to sentence him to at the minimum 2 years jail time. We felt that any normal person could see that my brother did nothing wrong but he wasn't willing to take that chance and go to jail for a non-existent crime. Not much of a choice.

The prosecutor told us repeatedly he was using the case to make a political statement because he was up for re-election and wanted to show he was hard on crime. There was no crime. My brother had just gotten off work and picked up our mother from work when the ice storm hit. They were within 10 miles of home when my brother turned at an intersection and his car slid sideways across the sloped road toward the ditch. The car was stopped across the shoulder for a good 20 to 30 seconds before a guy towing an overloaded trailer filled with hay bales and no trailer brakes t-boned them and my brother's passenger was crushed in the impact. He died 18 days later. What was my brother's crime? Not keeping his car until control at all times.
