Our attorney was gung ho for a jury trial for a long time. "Open and shut" he kept saying. "Everyone's car has slid on ice and snow at one time or another and any normal person would put themselves in your brother's place and find compassion in their hearts". Then the prosecutor decided to run for re-election and it became a political battle. The judge in the case told our attorney on the record that what the prosecutor was doing by pursuing the case was wrong. He said it was an accident and if my brother was being dragged through the mud for it why wasn't the driver who hit them on trial, too? No one ever answered that question. The judge said if my brother made a deal he'd be better off because he could oversee it and have input but if a jury went with the prosecutor there was nothing the judge could do to protect my brother and he'd be at their mercy. Two different times the judge told the prosecutor in open court that he felt it was wrong that the case was being pursued and strongly suggested he rethink it. But he didn't. This is why I have no faith that anything said in court is the truth and above board and I would not be able to come to an objective opinion. With any luck my group will be dismissed before I even have to go.
